General Terms and Conditions of Sale
Article 1 — Purpose and scope
These General Terms and Conditions of Sale (hereinafter "GTC") apply to all sales concluded on the website https://bestofyourself.co/ by the company BOY (Best of Yourself), a simplified joint-stock company with a capital of €22,600, registered under SIRET number 102 899 572 00014, with its registered office at 2 rue Doncaster, 69760 Limonest, France (hereinafter "the Seller").
Any purchase made on the website implies full and unreserved acceptance of these GTC. The Seller reserves the right to modify its GTC at any time. The applicable GTC are those in force at the time the order is placed.
Article 2 — Products
The Seller markets food supplements, sports nutrition products, vitamins, minerals, and other male well-being products.
Regulatory warning: The food supplements marketed on this site are foodstuffs intended to supplement a normal diet. They are not medicines and cannot replace a varied and balanced diet or a healthy lifestyle. Claims relating to food supplements are governed by Regulation (EC) No 1924/2006 on nutrition and health claims.
The products comply with applicable French and European regulations, particularly Decree No. 2006-352 of March 20, 2006, concerning food supplements.
Product photographs and descriptions are provided for informational purposes. The Seller reserves the right to modify the composition or packaging of products in compliance with current regulations, without prior notice.
Article 3 — Health Warning
Food supplements are not recommended for the following persons, unless otherwise advised by a medical professional:
- Pregnant or breastfeeding women
- Children and adolescents under 18 years of age
- Individuals undergoing medical treatment or suffering from a pathology
- Individuals allergic to any of the ingredients mentioned on the label
It is recommended to consult a healthcare professional before any use, especially if you are currently on medication. Food supplements should not be used as substitutes for medical treatment. If in doubt, consult your doctor or pharmacist.
The recommended daily doses indicated on the products must not be exceeded. Keep out of reach of children.
Article 4 — Price
Prices are indicated in euros (€) all taxes included (TTC), excluding delivery costs. The applicable VAT rate is that in force on the day of the order.
The Seller reserves the right to modify its prices at any time. Products are invoiced at the price in force at the time of order validation.
Article 5 — Order
The Customer places their order online via the website https://bestofyourself.co/. The order is definitively validated after payment confirmation. An email confirmation summarizing the order details is sent to the Customer.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order, or in case of suspected fraud.
Article 6 — Payment
Payment is made online using the methods offered on the website at the time of the order. The debit is made at the time of order validation. Transactions are secured by current protocols.
In case of fraudulent payment or payment default, the Seller reserves the right to suspend or cancel the order and initiate any necessary recovery procedure.
Article 7 — Delivery
Products are delivered to the address indicated by the Customer when placing the order. Delivery times are given for informational purposes. A delay in delivery cannot lead to any penalty or compensation, nor can it justify the cancellation of the order, except if the maximum legal period of 30 days is exceeded.
In case of delivery by carrier, the Customer is obliged to check the condition of the package upon receipt and to make any necessary reservations in case of apparent damage, directly with the carrier.
The risks related to transport are borne by the Seller until effective delivery to the Customer (transfer of risks upon delivery in accordance with article L. 216-4 of the French Consumer Code).
Article 8 — Right of withdrawal
In accordance with articles L. 221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the products to exercise their right of withdrawal, without having to provide reasons or pay penalties.
To exercise this right, the Customer must notify their decision to withdraw to the Seller by email at boy@bestofyourself.co before the expiry of the 14-day period.
Exceptions to the right of withdrawal: In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products unsealed after delivery and which cannot be returned for reasons of hygiene or health protection. Any product opened or whose security seal has been broken cannot be returned.
In case of valid withdrawal, the Seller will refund the Customer all sums paid, including initial delivery costs (excluding additional costs resulting from the choice of a delivery method other than the standard method), within 14 days from receipt of the withdrawal request or the returned products.
Article 9 — Returns and refunds
All returns must be subject to a prior request to customer service at boy@bestofyourself.co. Returned products must be in their original, unopened, unsealed condition, in their original packaging.
Return shipping costs are the responsibility of the Customer, except in the case of a defective product or an error by the Seller.
Article 10 — Legal Guarantees
In accordance with articles L. 217-4 et seq. of the French Consumer Code, the Seller is bound by the legal guarantees of conformity and hidden defects. The Customer benefits from the legal guarantee of conformity for a period of two years from the delivery of the goods.
In case of a lack of conformity, the Customer can choose between repair or replacement of the goods. If repair or replacement is impossible, the Customer can obtain a refund of the price or a price reduction.
Article 11 — Responsibility
The Seller cannot be held responsible for damages resulting from improper use of the products, non-compliance with recommended doses, unreported drug interactions, or contraindications ignored by the Customer.
The Seller cannot be held responsible for the non-performance of the contract in case of force majeure, disruption or total or partial strike of postal services and means of transport, flood, or fire.
The information and advice provided on the site are of a general nature and do not replace the advice of a qualified health professional.
Article 12 — Personal data
Personal data collected during the order is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR — EU Regulation 2016/679). The Customer has a right to access, rectify, erase, and portability of their data by contacting the Seller at boy@bestofyourself.co.
Article 13 — Intellectual Property
All elements of the site (texts, images, logos, brands) are the exclusive property of the Seller and are protected by intellectual property law. Any reproduction, even partial, is strictly prohibited without the prior written authorization of the Seller.
Article 14 — Mediation and dispute resolution
In the event of a dispute, the Customer is invited to first contact the Seller's customer service at boy@bestofyourself.co to find an amicable solution.
In accordance with articles L. 611-1 et seq. of the French Consumer Code, the Customer can use a consumer mediator free of charge. The Seller adheres to the following mediation service: CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice) — www.cm2c.net.
The Customer can also use the European online dispute resolution (ODR) platform accessible at: https://ec.europa.eu/consumers/odr.
Article 15 — Applicable law and competent jurisdiction
These GTC are subject to French law. In the event of a dispute not resolved amicably or through mediation, French courts will have sole jurisdiction, subject to the mandatory provisions of consumer law applicable in the Customer's country of residence for consumers in the European Union.
